  • hi guys this is the story


a friend has a gmt master a cheap rep


he just put it on ebay they sell it for 250 dlls and he puts its a asian movement inside he does no try to pass the watch as gen
and he sold the watch the buyer was happy and everything just yesterday receives a email from this folks he needs to pay 350 dlls to feb 18 or rolex watch company gna take legal auctions

and he are scared

what my friend can do pay or just ignore it???

Why would your friend be stupid enough to sell a rep on eBay and not expect problems? He ought to just pay for being that dumb.

If it is an real letter from an Lawyer you will find Numbers from the Judgment etc.
And what will happend if you not pay?
Then will Ring the Police at his Door and bring him into Jail?

No bro... but i would check your Email Account etc i mean your Friends.

Because it seems so they have ripped his real Adress :)

Well, actually there are lawyers assigned by Rolex and many other legitimate luxury firms that do just this. They hunt down sellers of fakes and try to intimidate them into admitting guilt and paying a small fine. They feel that the seller will cease selling and the small fine covers their expense of sending out letters.

On the other side, if you ignore them, they will probably disappear. They aren't going to have you arrested. You just have to be willing to take that chance.

Well... I'm not a law expert, but, as far as I know, trademark infringement is, when you, personally, MANUFACTURE the product with trademark, already patented by somebody. Logically speaking, selling such a product IS a crime, at least in USA, but no way an infringement.

Apparently these guys are a bunch of losers trying to intimidate anyone selling bootleg DVD's or fake merchandise on the Internet, so far no reports of action being taken by them, just ignore the emails.

I'm smelling bullshit, or a scam at the very least.

These guys are a bunch of assholes from what I've researched. I got one of these letters and am ignoring it. I actually had a genuine Rolex dealer clock on Ebay, not one of those ones that run on a AA battery and they shut down the auction, sent me their letter that they send to everyone with a few changes like demanding I send the clock back to them because this was never meant for resale, and to also surrender any items I have that are Rolex, give up my source where I got the items, not to destroy the items or contact my source and to list all Rolex items I have made a profit from. Not only that they would then determine any restitution I would owe after I willingly gave them this information incriminating myself. From what I understand this is a ploy to scare the shit out of you so that you will pay them right away. If you don't live in the same state they would have to file a lawsuit in the state you live in order to seek damages. Not really worth doing for $350.00. Again it is a tactic to scare the shit out of you and force you to incriminate yourself. This is my clock and they can't have it back. Ignore it, I did and no one has come knocking at my door. Also they send a letter by snail mail which is not certified. Unless it's certified with a case number attached and you have to sign for it, it ain't shit. Yeah, bitches ain't shit but hoes and tricks lick on these nuts and suck my dick you douches.

Gutter lawyers at their worst. AFIK these guys do not even need to have the authority of the company involved to act in this manner. Does the letter claim they are acting for and on behalf of Rolex SA? Chances are they are not retained by them and if they are it will be a very loose agreement. It is almost (but not quite) a scam to relieve you off $350 that relies solely on people being scared enough to send 'em monies. eBay must be handing out a crapload of addresses with only the barest evidence of entitlement. I have a feeling they would be in breach of the privacy laws here in a lot of cases.

I worked for a company whose main competitor was super litigious. Their legal philosophy was single bullet shot to the head. They would let you know that regardless of merit, they could outspent you on legal 100:1. You would be broke before you were right.

Still hate those *******.

Yes they are actually counsel for RLX USA, and many other brands. Just do a google search of the firm and many sites pop up of people being scared and asking questions of what to do and a lot of these people admit to just sending the money. Sorry about mentioning names I will be more discreet in the future.

There are a lot of lawyers (secretaries probably) who search the internet for alleged trademark infringements. They send thousands of letter per month in hopes of recovering fees and not forfeiting their trademark for adverse use. 99% of the time, they will not pursue legal action unless you are big player in the market if you just ignore them and stop selling, but we can't give you legal advice and tell you not to respond or assure that they won't sue you.
