Ironically it is a chinese woman who is proposing the legislation in NY making it illegal to buy or own replica items. She says the new law would cut down on demand... haha I don't think so. I think it would increase demand.

The streets of Manhattan have always had illegal activity. You can pass all the legislation you want. There will always be a Nigerian guy with a suitcase full of goods looking to sell you what you want.

The threat of a year in jail and $1000 would scare a lot away but like you say, it would be pretty hard to enforce that one. Always be someone selling and someone buying.

The problem there though is it would actually make it illegal to own reps.

You can make it $10k. They will still do it. I grew up watching guys roll in packs with 3 card monte stations. In seconds they would roll up and disappear. It won't do a thing.

...if you bought it AFTER that law will pass. And only in NY. But I don't think this law will ever fly.

Perhaps not but one thing is for sure, they are attempting to rachet up the pressure. I'm not so sure NY would not pass this law, we will see.

Not sure it would pass muster in a challenge anyway. Trademark laws are federal business, so passing state/local laws about them are usually trumped by the federal law anyway. Same as when someone tries to involve state unjust enrichment or liability laws in a trademark or copyright suit. They get tossed because the federal copyright act (or the lanham act in this case for trademark infringment) takes precedence on those matters.
