I thought of something. If you get sued, you can serve them with discovery detailing the actual cost to make a watch with all the associated proof. Probably less than a rep lol

Totally disagree with this post. Read the letter in this post. Look at who signed it. Angelo Mazza is the real deal. No law firm would claim to be "general counsel to Rolex U.S.A." if it wasn't true, or they would be subject to legal action by Rolex.

I think a lot of the threat letters people get are legit. But not the OP's. The real cease and desist letter you linked to is credible... in part because it doesn't demand that the recipient send $350. Real law firms don't do that.

This is clearly a scam, and the "law firm" (it's not a law firm) has no relationship with any real watch company, let alone Rolex. Rolex has $4.5 billion in annual revenue. I promise you the attorneys they use charge a minimum of $500 per hour, but probably a lot more. In the history of law, no legitimate firm servicing major companies has sought fees from targets of legal proceedings. Real law firms try to collect substantial sums for their clients, and then charge the clients on a contingency basis or by hours of work.

The letter you got is from a guy trawling eBay and sending Nigerian prince-style scam messages to fake sellers. It's best not to respond, but you can also tell this clown to fuck right off, and he can't do anything about it.

+1 their lawyers are definitely over $500 an hour, was at a party once with a lawyer and the whole time he was bragging about how they bill their clients $600+ just to recycle terms of service, operating agreements, and other generic forms.

Hi, a few weeks ago I was trying to sell a collection of old watches on eBay. I listed it as broken and replica watches. Not just Rolex, but a ton of different brands. For like 20 bucks. Very shortly after, it got taken down.

Then just a few days ago, I got both an email and letter from Rolex's law firm, GAF Counsel. They demanded me to stop all sales, provide invoice n profit history, and send them $350. If I don't by the end of May, further action will be taken.

I need opinions, cuz everyone here seems to be on point. Like I said, I never claimed them to be real, the listing never sold, and I have never sold anything Rolex in the past.

I did a search and saw that people have gotten letters in the past, but their situations were different, and no outcomes were ever posted.

Just need some advice. I was banking on a $20 auction....I can't afford $350 lol

This is a scame, plenty of this low life ppl trying to make a buck. Ignore it and just take down them ebay posts and sell on here :drinks_cheers:

Guys, this is NOT a scam. I’m still waiting for the OP to send me a copy of the letter, but I have seen them before. The money they request is simply to cover their clerical fees...it does not reflect their hourly rate. If they do calculate it based upon the attorney’ time it is most likely for (.5) 1/2 hour of work. Therefore, they would be billing at $700 an hour which is right in line with hourly fees charged by IP attorneys in large cities. maxdamage if you haven’t been shackled and sent to solitary confinement please PM so I can get a copy of the letter.

This just reminded me of the days where the internet company send you letters regarding illegal downloading.

But, on the other hand, should we worried about purchasing reps from China, because they are on to us? Or, this is one of those unlucky situations with careless intentions?

At least in my country they don’t try to sue you for importing a fake Rolex. The letter I got was an agreement to destroy the rep. I think they would have a hard time convicting anyone for buying a fake if you deny knowledge of it unless they really wanna bring in the big cannons and get a warrent to search your mail and what not which you could just delete anyway and even then I think you could pretty easily get away. If you’re selling stuff it’s another situation. But then again I’m not a lawyer.
