He invoiced me for the 3717 and I paid $350 for it. I am worried now, I am going to wait till Monday morning before I start getting really worried.
This thing is looking fishy and I don't have a good feeling :(

So its definitely not a situation of both of us getting invoices on 4/3 and you delaying your payment until 4/7, and some
sort of miscommunication.

1. I get an invoice on 4/3/08: I pay immediately.
2. You get a separate invoice on 4/7/08, so he can get paid again?

Not looking good....

I really hope this ends well.
I was along with Optimus scammed by a scumbag a year ago, we communicated a few times at that time and OP seemed like a genuine good guy ; that is the previous posting others were referring to; but that situation was not OP's fault.
He ended up getting back his money from a sucessful paypal dispute, so he knows how PayPal works.

Can't imagine he would turn scammer, hope that is not the case and he will chime in soon with an explanation.
What about the other watch he was selling, did anyone buy that ; maybe he thought he sold the 2 watches, 1 to each of you?
Not trying to make excuses just trying to make sense of it.

My gut says to give him the benefit of the doubt for a few more days.

But its complete BS.
On 4/3/08 when I was in communication with him so efficiently was being he has a handheld that
he uses for email (Treo), so its not like he's every very far from email.

Its just about courteous. I'm not asking for him to go out of his way to contact me. Just simply pick up his Treo and say...
"hey, i'm busy this week, can't ship"
"hey there was a miscommunication with another buyer"
"hey [insert whatever u want]"

And then on top of that to learn he sent out another invoice on 4/7/08.

you can give it a little bit of time, you never know what has happened.. below is an excerpt from paypal's UA:

PP UA said:
13.3 Filing Deadlines. We will not grant any Claim unless you first initiate a Dispute in our Resolution Center within 45 Days of the date of the relevant payment and then escalate the Dispute into a Claim within 20 Days of the date you file your Dispute. It is your responsibility to keep track of the deadlines under this section.

so you have 45 days.. its not going to hurt to wait a few more ;)

Well this was my give and take with OP:

Well he first contacted me via email, before he even listed asking if I was interested, I asked him If the Slevin came with the bracelet. The same question I later had asked on his Slevin listing. But he never directly responded to me either of the times. and right after he responded on the sales thread to my question I shot him a P.M saying (I will take it) But he never wrote back and marked the watch as sold and he never responded to my P.M. Thus the reason i did not trust him. After reading this whole thread, I can make one conclution that he might have mistaken the two 3717 payment with the Slevin. As the slevin sold later than the 3717. He might have confused the numbers between the slevin model number and the Pilot choronos. Thus we have two buyers who believe that they both got the 3717 but the seller might have gotten my P.M confused with the other buyer who rather wanted the 3717. So one of your guys probobly the second buyer will probobly recieve the Slevin, If all goes through. This is just a guess, But I was somewhat a part of the communication with the seller, Though he never responded to any of my P.Ms or Emails.

Hey guys, im about to jump on on on plane and responding from the blackberry.

I purchased the slevin from OP with paypal for 400 and have had no communication with him after multiple attempts.

I thought it was strange he listed who he had sold to (as if trying to prove something) but went against my better judgement and got it anyway.

I will be on later tonight with on on follow up post when i get off the plane.

Now I am feeling shitty. Slevin buyer has emerged and all doubts are gone. We have been scammed.

What is the method to go with paypal to file dispute???

I hope you used a credit card though PayPal. If this was a deliberate scam there will be nothing to recover in the sellers PayPal account. If you used a credit card at least you can charge it back. Paypal disputes only work on sellers that leave money in the PP account. Good luck.

Wowzer!, Now that I can certainly say, due to the presence of the Slevin buyer, this might be a scam. I would certainly urge the buyers to file the dispute with PayPal on Item not received.

more particularly, a visa. either mastercard or discover have a deal with paypal where they won't allow chargebaks, instead say you have to go through PP's dispute process, as they are just the 'middle man' and not responsible...

er, or maybe it was visa.. one of the big 3 have a deal with PP...

and, yes, if you pull the money out of your account, paypal will first make their account into the negative, then lock the account, then start sending letters from their "collections agency" (who admit when asked point blank that they are no infact any legit collection agency. .and do not report to any credit agencies, and they really have no power). Though, at this point, if the seller is 'verified' or some other status, then they will pay out out of their own pockets to the claimer.. (sometimes... maybe) if its not a 'super mega awesome verified dood', then you are SOL. I still have a claim 'open' from about 2 years ago, that was filed in my favor, but no funds available.

Don't ask me how i know this.. fradulent claim made on me i decided to fight... and eventually lost as i wanted to coninue to sell shit on the bay.

3 payments, no correspondence this is no longer a concidence.
What a shame.

I think the Mods may have some information on this member from the previous dealing last Fall, hopefully they can reach out to him so we can get some answers.
When I did a PayPal claim, PayPal gave me a date when the seller had to respond, when the seller did not respond with tracking or any proof of delivery they a week after that date refunded my money paid,I am almost positive I paid with a cash balance, so I hink you will get your money as a lack of delivery claim ; just will take a few weeks.
