Why will tell Customs the watch you are expecting is FAKE

Last week I sold my BKYM to a member of this forum. I told him before he sent payment that customs risks is shouldered by the buyer. I sent the watch to canada via fedex. He gets a notice from fedex telling him that the package has arrived and he needs to pay some duties. He refused to pay the duties and told customs that the watch is FAKE and that there should not be any duties. The buyer sends me a message and asks me to tell fedex that the watch I sent is Fake so he does not have to pay USD 40 for the duties.

Fedex calls me up and tells me to go to their office as there is a problem with my shipment and that it is illegal to send fake watches. Now, they are asking if I sent a fake watch. They are telling me that the watch could be confiscated or sent back here with a penalty of USD180. They also told me that they will charge the fedex branch here a PENALTY for allowing a fake watch to be sent. Now the fedex branch here is worried and wants me to visit their branch.

What should I do?

Awww that sucks, I have no advice for you but I hope that if something happens it will be for the buyer... 40$ is nothing compared to what is gonna be a pita for you to deal with :(

That would make me extremely angry. I guess it's good that there's now a VIP only sales area, to reduce the chances of incidents like this.

Yes, selling to noobs overseas can be a big pita. Only sell overseas to well known members or vip. Helps to get out of the way with trouble...

I would have simply said its my own watch (which is real), I sent it to somebody for repair and I'm getting it back.

some people forget the nature of the hobby we are in...

To be honest you should probably deny it, and wash your hands of it. If you admit to fedex that you did ship a fake watch then you could be in more trouble as they are going to pass any blame or fines from Rolex onto you and I doubt they will ever give you the watch back!? How would it get back through customs.

It's the buyers fault not yours.

Geez.....I would be really pissed off with such a buyer, honestly....I mean 40 bucks....and that too on a BKYM.....Canadian customs are hyperactive and are known to impose a lot of duties on stuff imported from overseas.......Not only that they also confiscate packages (eg. fragrances etc) if they spot them in the package....This guy, should have been grateful that he was only stiffed with 40bucks in duties on a fake Rolex........Anyways.....it's past that stage now.....it's a dilemma for you really..........I think if you claim it was a fake watch, the watch could potentially be seized.......calling it a GEN in my opinion is your best choice.....and then you can call it back to you as the buyer will not pay the hefty duty on a so called 'GEN' Rolex.....you'd probably get your watch back but would be asked to pay the Fedex fee which I assume would be a lot too....That ofcourse you can sort it out between yourself and the buyer...........Good luck mate....

Thanks guys. I really don't understand why he had to insist to customs that the watch is fake. Btw, here is the message the buyer sent me:

ok, i've talked to Fedex and here's how you can help in fixing this.

fill out a new invoice stating that it's a fake rolex that you got in the night market or china somewhere and that you are sending this to your friend as a fun gift.

then declare the value as like $40

take a picture or scan the form and email a copy to me and then i'll fax it over to their office here so that they can reevaluate the taxes and duty.

please do it as soon as you can as they'll only hold this for 5 days.

Wow, sometimes people are so dumb....I agree with the other members in which to say the watch is real..and to say the watch needed a new strap or something which was a third party strap and needed to be sent away.
This is the only way I think you will get the watch back.

its similar to that pay pal incident where the new dealer got stung by a numpty putting replica watch on his payment , shannon had a good idea using the return watch from repair note inside package,name and shame this fool,why didnt he contact you first,i would have just given the fool the money to pay fees, very awkward situation id say i bought watch and sold it on as genuine product just play dum!!!

Tell them it's a gen, then contact the buyer and split the payment 50-50.if he complains about that $20 then tell him to **** off.. if he says ok, do that and wash your hands of it.

It's unfortunate that this situation has arisen from this. But to be honest, as a seller i'd rather pay the $20 or if at worst case $40, than risk the chance of a hefty fine from FEDEX/Canada Customs etc. Remember you declared the goods.

Or you can kick the buyer in the face, say to customs/FEDEX you didnt know it was a fake, and tell them to confiscate it. see how the buyer likes that... ok im just kidding

Really sucks bud, hope all works out.

yes mate but courier has come back to him saying he knowingly sent a fake watch which is against the law and in the small print in all postal terms and conditions, the buyer has really stitched this guy up, come on guys lets help him get this sorted.!

OMG !!

I can only facepalm at these idiots that say to the FEDEXS that it is an replica and its not to have tax for it !!! OMG !! Just tell him he have to pay the 40USD or he can **** off, because you don't want to do anything with it.

What a waste of a good BKYM, no wonder some forumers choose whom they like to sell.

If he didn't want to pay the $40 duties, he should've just shut up and rejected the package so that it will be sent back to you without this incident.

And while we're here, sending packages via Fedex/DHL/UPS is not a good idea, I've read too many horror stories about them. Registered airmail and/or EMS is the way to go.

Thanks everyone. Taking note of all the comments. Fordystar, I really appreciate the concern to help me get this thing sorted.

I already contacted Fedex and told them that as far as i know, the watch is genuine. I figured nothing good would come out telling them that I sent a fake watch. I still need to talk to another fedex personnel as apparently Fedex Canada has called them again saying that the receiver is insisting that the watch is fake.

I already PM'ed the buyer requesting him if he could stop telling fedex canada that the watch is fake.

looking round courier boards and other peoples experience, say you bought watch as a genuine product and sold it as that, ask if the fees could be paid ($40) to complete delivery and then would be collected by yourself to then give the buyer a full refund,(then forget all about it)as you are then seeking legal advice to get your money back from your transaction from when and who you bought watch from as you will be taking the watch to an a.d to have it authenticated.
Definatly do not admit you knowingly sent a replica watch, this idiot whos dropped you in it should be hung drawn and quartered, really feel for ya!(ask buyer to say he thought he could avoid fees by claiming it was replica and he is sorry for this, which may help you massive ammounts)

Seems fair to me. Buyer is the author of his own misfortune, and in any event he expressly agreed to bear all Customs risk.
