My first bad Ebay experience!

Today i had my first bad experience with an Ebay buyer.

To start this story. A few month ago I heard about a old watchmaker that choose to retire. So he sold his belongings at a local auction. I went there but I didn't bought much but I found this box that contained lots of never used metal bracelets and parts for brands Like Enicar, Atlantis and Zodiac. The final bid was mine and I got it really cheap. So I started put them up on Ebay and got a bit suprised when the first bracelet sold in 10 min with "buy it now" for 99 usd + shipping. The buyer was a Enicar collector from Germany that told me that this bracelet were very rare and he was excited to get it. Then i told him that I got a lot of about 15 pcs of this particular Enicar bracelets and some other models and parts for Enicar. He wanted a picture and after i send it to him he bought some parts and another 5 bracelet for a total of 600 usd.

I shipped out and I'm in a nearby EU country so the package were delivered 2 days later in Germany.

I got a mail response that said thanks a lot the items is just what I were looking for from the buyer.

So far all is great and that was a really good buyer.

Now to the bad experience!

With the success of selling this I put up another one and it sold also quickly. I continued to put up an auction every 5 days and the bracelets went from 66 to 99 usd to different buyers.

Today I got a mail from one buyer that I sold to a week ago.

He also live in Germany but he claim the package was send from China and he had to pay 36 usd in taxes and that its a "cheep kopi" he also told me to refound the whole cost + shipping + the 36 usd he had to pay in tax or he will report to Ebay and start a PayPal dispute.

But I have proof of sending this package to him with tracking No. from a nearby EU country. Also when I search the tracking No. at deutschepost.de I get proof of delivery with this guys signature.

As I'm a newbie to selling at Ebay (only bought things earlier) should I be worried? And what should I reply to this man that obvious have problems with reality or suffer from mythomaniac issues.

If you have a good record with PayPal and a better feedback on eBay than that buyer,that proof of delivery you have should win you the dispute without issues. If somebody has more experience with these disputes please share your opinion.

You tell him that import taxes if he paid any are his obligation. You tell him the item is genuine however if you are unhappy you are happy to refund his money once the item is returned to you at his expense. Tell him you dont usually offer refund but in this case you will refund it to keep him happy. YOu want to communicate this in ebay. If he starts communicating it in paypal, make sure you type the same thing and if he escalates it to a refund, you insist it is genuine and that you will refund his money once the item is returned to you at his expense with proof of delivery

The bottom line, offer the refund....at least you can sell it to someone else

The thing is I have about 25 feedback but the buyer have over 800 in feedback. Also this mail came only minutes after i give him good fedback as a buyer... I still have the shipping proof and i doubt he have proof for the customs fee he claims and if he had it from another package it will not match the tracking No. I send. I don't know the routines about import taxes and customs in Germany and if they are connected to the specific tracking No. of the package.

I hope for the best and return him a mail of kindly written facts.

If you sell and ship inside the European Union, there are definitely no taxes/duties. It is that easy, it´s the law, no borders, especially trade-wise, inside EU.

Reading your OP, I thought you shipped from inside EU.

In other words, if I read correctly, this problem cannot come from your package. It must be a different purchase this guy made.

However, if you are in Europe, but a non-EU country like Switzerland, then for sure taxes and duties apply for goods at the value you described.

If you have a legitimate tracking number and he has signed for the package then all should be fine. The most important thing with ebay disputes is that you must do all your corresponding through the ebay resolution center. Any dispute will be refereed by ebay with reference to the resolution center messages held by ebay. When you message the other party you are basically presenting your side of the case to ebay so its important to appear to be fair factual and reasonable. Point out that the items came from a reputable source etc etc. Good luck....Oh and never leave feedback until the buyer has left good feedback for you first.

Problem is PP usually sides with the buyer... especially when he accuses the seller of selling counterfeit goods. Stick to your ground and make sure you post EVERY single bit of info you can otherwise you'll find PP automatically siding with him. Unfortunately I think he knows that...

Thank you guys! I told him the fact that I have the shipping proof also attached the delivery proof he signed and send it via the Ebay communication. I also said that if he can prove that he pay tax for that tracking No. I will refund him.

As you told me here the law sending from EU to another EU country is that it's no taxes or fees. So on this I'm now 100% sure.

I will update if I got reply from this buyer.

eBay seems to removed the negative feedback. Just logged in and had 100% positive feedback. :)

Good deal. I've not dealt with Ebay out Paypal since last summer and only then very reluctantly. Unfortunately it's the best marketplace out. I have an acquaintance who sells watches on Ebay in excess of $200,000 yearly and he tells me at least one transaction in ten lately is nothing short of asinine. Buyers basically extort Sellers to receive partial refunds after the sale knowing that since essay changes in feedback policies Sellers have no recourse. Someday someone will knock Ebay off the mountaintop.
