Is it OK to sell replicas on eBay, as long as it's clear that they are?

HI guys,

First of all, I know eBay rules forbid selling counterfeit goods.

Taking that under advisement, how do you guys feel toward a watch being sold on eBay, if it clearly states that the watch is a replica (so, no scam attempt)?

Is it acceptable, as long as eBay doesn't remove it (they make no effort to remove clear fakes being sold as originals, so why should they bother with the replicas clearly identified), or should we report them also?

Note: I don't have any eBay auctions running, watch related or otherwise. I'm just curious on what to do in those situations

We have lots of threads on reporting fakes/replicas on ebay. Ebay doesn't immediately remove replicas because the guys who check don't know any better. I think they were planning to hire people who were knowledgeable on each brand. We were even considering applying for the position. :lol:

Ha ha ha... Certainly they won't find a lot of people more qualified as some of the experts here.

So the rule is to report, even if the item description clearly states that it's a replica, just like the example above, right?

If it's clearly a fake rip off item than yeah report it, but if it's a stainless steel bezel that is clearly stated as after-market I think stuff like that is fine IMO

There was a thread a couple of weeks ago either on here or RWG where a guy selling a replica on eBay was hounded by Lawyer's letters from Rolex. When they got no response from him, they started phoning him. So if you own absolutely nothing, by all means, have some fun ....

AliExpress has banned all accounts selling reps and it's likely eBay will too once they figure out its happening. Counterfeit is still fake is still replicas.

It's against the eBay terms, so yes, report it. Just because they state it is a rep, doesn't mean it's the place to sell the watch.

There was a fake Panerai on sale on Ebay a while ago, I was reporting it twice a day everyday for several weeks, can't remember if they took it down but Ebay did send me an email asking if i'd like to be a 'Panerai Expert' for their anti-fraud team - pretty funny as I know next to nothing about Panerai.

IMO it all depends on semantics and the definition of what constitute as a 'replica'
Some WIS would consider franken watches with sterile cases set and genuine trademarked parts (e.g. crown and dial) still a replica watch - even though the trademarked parts are genuine and the case is sterile

I consider a 'legal' franken (i.e. sterile or genuine case with non-factory spec or assembled genuine trademarked parts) as ok for sale on ebay, as long as it is advertised and portrayed clearly as what it is without the intent of misrepresentation, deception, and/or fraud. Such franken watches with such characteristics are not counterfeit items and are okay on eBay as long as they are sold without misrepresentation.

I have seen people selling on ebay without their ads getting taken down (likely because these ads were very clear and did not misrepresent anything)
1. TC franken builds with gen dial, gen crown, gen 3135 and gen bracelet, and a sterile TC case
2. Vietnamese 5513 case with gen 1520 movement + gen dial + gen crown, but i am not sure if the case is sterile from the pictures
3. Gen Datejust case with ETA movement
4. Gen Tudor with Rolex dial

But anything that is outright fake with trademark infringement and counterfeit parts, along with the intent to deceive, misrepresent, and defraud others is a big no-no
