Because it doesn't say Rolex on it and doesn't copy any trademarked technology.

No idea but Steinhart etc.. All do the same, all of them just blatant copies of Rolex and the like IMO.

What makes me laugh is over at the gen forums rep owners and fakes are considered 'scum', 'fake people' and the gen owners mostly buy into that whole 'dont buy the look if you havent got the cash" idea etc..
Yet when one of them buys an invincta sub or something similar everyone starts whooping, hollering and high fiving each other "nice invincta man" "great Steinhart!". It's horses for courses but I've never understood it and would love to know how they get away with it legally. Surely a companies IP consists of more than a name and logo, what about the materials, design, dimensions etc... Don't they count against copyright infringement.

By just changing something, even very subtley, they get away with it. Its not like a rep, from a distance it may look similar but close up its a tell. Some reps dont have that 'fault', hence the flack us collectors get. :)

So, over on WUS they take the position that the words "Marina Militare" and Panerai's crown guard have trademark protection. I can understand the latter since it's mechanical, but how do they protect words? I mean, did they bribe an Italian judge? Sheesh.

In my work I have had to have a fair bit to do with copyright law. In Australia at least, copyright is "asserted upon creation" of basically anything a person designs. The law here is that a person accused of infringement must prove they did NOT infringe the design of the creator. This is never cut and dried but an important consideration when people are doing these things.

I have found that the "advice" or opinions provided by anyone who is not expert (me included, I hasten to add!) in the specific field of copyright/patent law is almost always wrong in their understanding.

Intellectual Property law is BIG business .... nearly as big as the brands they represent! My ex-FIL is a patent attorney in the drug/chemical industry - now THAT is a minefield!

i don't get it either. invictas look just like a rolex; but i'm a punk if i just buy a fake rollei? come on. i would rather just buy the fake and be done with it. i love the look but just don't want to pay for the gen rolex, so i just skip over all the near-beer and head right for the black market...

TRAILBOSS - aren't they though? A real testament to the creators ..... of the originals I mean of course!

The cars that I have seen rep'd well include:

Ferrari - 250GTO 250 GT California (Bueller!?) 365GTC (Daytona) 430 scuderia and spyder 360 spyder and coupe

AC Cobra - 1:1

Lamborghini Countach, Diablo, Murcialego

Porsche 911, 930, 356 (and one poorly executed) 944 turbo.

and on it goes .... when done fanatically well - they are a dream. Saw my first 250 gt California in 87 at Pomona swap meet in Calif. At $50K 'turnkey' it was steep for the time and the subject of much legal action eventually causing the bankruptcy of Modena Coachcraft. (Still have their brochure somewhere) It is being produced in the US again and for mine, is among the most beautiful reps ever made.

the big issue for reps is running out of puff before the project is completed and lack of attention to details like interiors and wheel configuration.

AS someone fortunate enough (in a past life) to have owned several exotic sports and GT cars, I can say that Porsches win every time for me ... brilliantly designed ... more than 25,000 race wins ... had electronic fuel injection, 5 speed gearboxes, electric sunroofs and windows, carpets!, all wheel disc brakes, 3 speed wipers and 185 BHP from 2.2 litres IN 1968! Oh and they handled beautifully if you knew how to treat them. On the other hand, there's a reason why there are so many LOW MILEAGE Ferraris and Lambos on the market - always in the bloody shop! So to own something with the styling of a Ferrari and the reliability of a Toyota - gets my skin tinglin'

I've had a few nice ones too mate. 308GTB ( not for long :) ), '72 450SEC (manual), XJS, M635, 930, 911 and a Pantera. All well in the past now.

I am currently building a P4 Ferrari with the BIL and his dad is working on a Countach from scratch. He built the spaceframe himself.

P4 will have a 360 engine/transaxle and custom suspension setup while the Countach is running a Jag V12 twin turbo with Benz running gear.

Countach ... oboy .... a rep will be better than the LP400 POS I had .... being a fellow Aussie I will give you a hint where it went after me ..... it got a paint job ..... pink ..... it got an interior change ..... mink! .... know what I'm sayin'? ... wink

oh and then it got a pop-up glass sunroof whacked in the roof .... money and class don't always meet

The guy building the Countach is an ex F1 engineer who worked for Ferrari, Porsche and McLarren. He did the frame from memory :)

No, the P4 will be road legal. You don't wanna know what the wind screen just cost him to have moulded. So much he had 3 done just in case as it didn't add that much to the cost.

Luckily apple isn't in the watch biz or they probably would claim they invented time itself and would sue anyone trying to make a watch. ;)

Kind of construction related. I've written a lot of informative pieces and legal docs which have been blatantly stolen by competitors. One even forgot to take my company name out in one place in the body of the text!
But apparently if they just change one or two words in a two page doc, or shift the order of paragraphs, you're SOL unless you want to spend a fortune in legal fees.

This is an interesting thread....isn't great we can all get along and turn a nose up to the "more, more, more , more" guy. More doesn't mean happiness....its COOL to own a RestoMod car vs. the gen right....I have started calling replica's "homages"...my interpretation of the original. Does it make me a tool? I think not, it makes me SMARTER than the tool that has 10's of thousands tied up in something he can barely drive and enjoy or a watch that sits on a box so he can enjoy the ego trip of sayin g, " I have this or that". I used to trip when I banged my gen 16610 or took it off in a seedy area, now I can beat my "homages" to hell and back and not give a shit. God Bless Replica's.

In the early 90's I bought a really nice 1974 911S Porsche. It was factory black and had a well maintained (rebuilt) engine and had enjoyed 3 reasonably careful owners.

Much to everyone's horror (during the build/rebuild process - I mean, let's face it: a 3/4 finished renovation looks like a ruin) I transformed it from that to a 1993 3.6 litre twin turbo replica. I went to town on this thing, getting wheels made for it in Japan (originals were more than $14,000) transforming a very spartan interior into a nice custom job and adding all the make-or-break details right down to door locks that blinked when the alarm was set.

I am very happy to say that for a few minutes anyway, it fooled the sales manager of Hamilton's, our country's Porsche importers, who asked me why I 'grey marketed' the car when they'd have been happy to supply one.

I was a happy chappy that day. Drover her around for 2 1/2 yrs and had a world of fun ... all the nay-sayers were blown away by the eventual result.

Oh and I spent a nudge over $21,000 on the project (plus purchase price) and made nearly $17,000 profit when I sold it to a guy who followed me from the city to my home just to tell me how much he loved it.

God, I love Porsches. :D
